These terms and conditions govern your use of our website, services, content, and communications.  By using this website and our services, you agree to the terms and conditions of KA Performance.

Before starting our program, please take time to read these terms and conditions carefully.  They explain who we are, the services and how we will deliver our services to you, the processes for making changes or ending the contract what steps are taken if an issue arrives, and all other details that are in these terms.

1. Services

Online Personal Training:

             -Workout plan (tailored to your needs)

             -Nutrition guidance/plan (tailored to your needs, meal structure recommendation)

             -Plan Adjustments (changing or updating workout or nutritional guidance based on                    client progress)

             -Progress Tracking (weekly-monthly check ins, optional progress photos, tracking                      workout and nutritional journey.)

             -Support (motivating clients, making sure that you are on track with your goals,                            and available to answer questions or any concerns)

             -Communication (website, email, text, call)

Read these terms carefully.  This explains how we will deliver our services to you.  

2. Coaching Agreement

2.1 How coaching services are accepted

Coaching services are considered accepted once we confirm in writing (including by email, messaging platform, call, or any other electronic communication) that your application has been approved and services can begin.  Once accepted, a coaching agreement exists between you and KA Performance, regardless of whether a physical signature has been provided.

2.1 If we cannot accept your application

If we are unable to accept your application for coaching services, we will notify you as soon as possible.  This may occur for reasons including, but not limited to incomplete or inaccurate information, our inability to provide the services based on the information that you have given us, health concerns, errors in pricing or service availability, or any other circumstance where we determine the coaching relationship is not an appropriate fit,

If a payment has been made prior to acceptance and services have not yet started, an applicable refund may be issued at the discretion of KA Performance.

4. Physical Activity Readiness Questionnaire (PARQ) 

Clients may be required to complete a PAR-Q/ health screening form before coaching services are provided.  By submitting these forms, you confirm that the information provided is accurate and complete to the best of your knowledge.  KA Performance reserves the right to refuse or discontinue services where participation may be unsafe or outside the scope of coaching services.  

5. Nutrition Guidance

Nutrition coaching provided by KA Performance is intended solely for general health, fitness, and educational purposes.  It does not constitute medical or dietary treatment.

Nutrition services may include different levels of guidance including general nutrition support, flexible nutrition coaching, and structured meal planning.

Clients are responsible for informing KA Performance of any allergies, food intolerances, medical conditions, and dietary restrictions.

 

6. Health and Safety Terms

6.1 You understand that:

Your participation in exercise programs and nutrition coaching involves inherent risks including but not limited to injury, illness, physical strain, allergic reactions, and aggravation of pre-existing conditions.  You acknowledge that you voluntarily participate at your own risk, and you should consult a physician before beginning any fitness or nutrition program.  KA Performance is not responsible for injuries, health complications, or damages resulting from participation in services.

6.2 Medical Advice

KA Performance does not provide medical advice, diagnosis, treatment, physical therapy, rehabilitation services, and mental health counseling.  If you experience pain, dizziness, discomfort, or any other concerning symptoms during exercise, discontinue activity immediately and seek medical attention if necessary.

All information and coaching advice that you receive from us is for educational and wellness purposes only.  We help with exercise and nutrition for body composition.

7. Payments & Billing

7.1 By purchasing services:

You authorize payment for the selected coaching program, subscription, or package. 

 

7.2 Where to find the price for the services:

The price for the services can be found on our website during the onboarding process, sent through email, or sent through call or messaging for the services as well as the date on which the first payment is due (Initial Date).  The price that KA Performance quotes to you will be valid unital the initial due date.  The price of the services may change if the payment has not been received the by the initial due date.  

7.3 Where to find the due date for payment for services:

When signing up with KA Performance, your first payment date is defined by the date you make the first payment to us.  This date will become your monthly recurring payment date.  If we do not receive a payment by the due date, we will notify you of it, and you will be required to make a payment within a 7-day period unless written otherwise on messaging, email, or call.  If we do not receive a payment in full of the amount that is owed within the time period that given to you, then we are entitled to stop providing services to you and/or to terminate our contract with you.  

7.4 What to do if you thought that an incorrect payment was taken from your account:

Contact us as soon as possible if you think that an incorrect amount or a false charge was taken from your payment account.

 

8. Refund & Cancellation

8.1 Refund Policy

Unless otherwise stated in writing, all sales are final, refunds are not guaranteed, and unused coaching time, missed check-ins, or partially completed programs are non- refundable.  If a payment has been made prior to acceptance and services have not yet started, an applicable refund may be issued at the discretion of KA Performance. 

8.2 Cancelation Policy

Clients may cancel coaching services at any time.  However, cancellation does not entitle the client to a refund.  We reserve the right to terminate coaching services immediately for violations of these terms, abusive behavior, harassment, dishonesty, or conduct deemed inappropiate.

9. Client Rights

9.1 Clients have the right to:

Receive services in a professional and respectful manner, ask reasonable questions regarding coaching services, discontinue services at any time, decline any exercise or nutrition recommendation, and have personal information handled in accordance with our Privacy Policy.

10. Our Rights

10.1 KA Performance reserves the right to:

-Refuse, suspend, or terminate services at its discretion, modify coaching programs, pricing services, or policies at any time

-require completion of onboarding forms, waivers, or health questionnaires before participation

-request medical clearance where appropriate

-remove clients from services for inappropriate, abusive, dishonest, or disrespectful behavior

-discontinue services for failed payments or fraudulent chargebacks

-protect its business operations, staff, intellectual property, platforms, and reputation to the fullest extent permitted by law

KA Performance also reserves the right to determine whether coaching services are appropriate for any individual based on health, safety, compliance, or business considerations.

11. Intellectual Property

11.1 All materials, content, and resources provided by KA Performance, including but not limited to:

Workout programs, coaching materials, nutrition guides, PDFs, videos, branding, logos, website content, app content, and educational resources.

All intellectual property of KA Performance may not be copied, reproduced, distributed, resold, or shared without prior writtien permission.

This does not apply to publicly shared material unless otherwise stated by KA Performance.

12. Limitation of Liability

12.1 To the fullest extent permitted by law KA Performance shall not be liable for:

Injuries, health complications, indirect or consequential damages, loss of income, profit, or data, technical interruptions, app or website downtime, or decisions made based on coaching information.

Participation is services is voluntary and entirely at your own risk.

13. Privacy

13.1 How we use your information

Your use of our website, applications, and services is governed by our Privacy Policy.

14.Governing Law

These terms and conditions shall be governed and interpreted under the laws of the United States.
